1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of PostBuzz, operated by PostBuzz LLC (“we”, “us”, or “our”), a Washington-registered limited liability company located at 100 N Howard St #7024, Spokane, WA 99201, United States. By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Description of Service

PostBuzz is a multi-tenant social media management platform that enables you to:

• Consolidate and schedule content across supported social media platforms;
• Generate AI-assisted content using large language models (including Google Gemini);
• Track post and campaign performance metrics;
• View unified analytics and historical trends;
• Manage team access and roles within organisations.

PostBuzz integrates with third-party services including Google (YouTube), Meta (Facebook/Instagram), LinkedIn, and X (Twitter) to enable secure publishing via OAuth. The Service is provided “as is” and features may change over time.

3. Accounts and Workspaces

You must create an account to use the Service. You must be at least 13 years of age; users under 18 must have parental or guardian consent. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date. We reserve the right to suspend or terminate accounts that violate these Terms.

Organisations may create multiple workspaces. The organisation owner is responsible for all users added to their organisation. Adding a member to your organisation constitutes your representation that you have authority to do so.

4. Platform Permissions and OAuth

PostBuzz uses OAuth to request access to your third-party platform accounts. These permissions are used only for features you explicitly enable, such as content scheduling and analytics.

We may request:

• Basic profile access (email, name, profile image);
• Publishing access (e.g., post videos, status updates);
• Page and channel management (e.g., Facebook Pages, YouTube channels).

You can revoke access at any time via your connected platform's OAuth settings. We do not use this data for advertising or resale.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Publish spam, unsolicited commercial communications, or misleading content;
• Infringe the intellectual property rights of any third party;
• Harass, abuse, or harm any person;
• Distribute malware, phishing content, or deceptive materials;
• Attempt to circumvent rate limits, access controls, or technical safeguards;
• Misrepresent yourself, your brand, or affiliations;
• Publish content that violates the terms of service of any connected social media platform (see Section 7).

We may suspend or terminate your access immediately and without notice if we determine, in our sole discretion, that you have violated these restrictions.

6. AI-Generated Content

The Service uses AI language models — including models provided by Google (Gemini) — to help you draft social media content. You acknowledge that:

• AI-generated content may be inaccurate, incomplete, biased, or otherwise unsuitable for publication. You are solely responsible for reviewing, editing, and approving any AI-generated content before publishing;
• We do not warrant that AI-generated content complies with the guidelines of any social media platform or applicable law;
• You retain ownership of the final content you publish, but you grant us a limited licence to process that content to provide the Service.

7. Third-Party Platform Terms

PostBuzz integrates with third-party social media platforms including (but not limited to) LinkedIn, Meta (Facebook and Instagram), X (Twitter), Google (YouTube), and others (“Platforms”). Your use of these integrations is subject to the terms of service and developer policies of the respective Platform, including:

• Google API Services User Data Policy;
• Meta Platform Terms;
• LinkedIn Developer Policies;
• X (Twitter) Developer Agreement.

You are responsible for ensuring that your use of each Platform via PostBuzz complies with that Platform's terms. We are not affiliated with, endorsed by, or officially connected to any Platform. Platform APIs may change or be withdrawn at any time; we will endeavour to notify you of material changes but cannot guarantee continued availability of any specific integration.

By connecting a Platform account you represent that you have the authority to authorise PostBuzz to access and publish to that account on your behalf.

8. Subscription and Billing

Access to paid features requires a valid subscription. By subscribing you authorise us (through our billing processor, Stripe) to charge your payment method on a recurring basis at the applicable plan rate. All fees are in US dollars unless otherwise stated.

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. Cancellation takes effect at the end of the current billing period; you will retain access until then. We do not provide refunds for partial periods except where required by applicable law.

We reserve the right to change prices with 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

9. Content Ownership

You retain full ownership of all content you create, upload, or schedule using PostBuzz. You grant PostBuzz LLC a worldwide, non-exclusive, royalty-free licence to store, process, and transmit your content solely to the extent necessary to provide the Service. We do not claim any rights over your brand, media, or content beyond what is needed to deliver the Service.

10. Intellectual Property

The Service, including all software, design, text, and graphics (excluding your content), is the property of PostBuzz LLC and protected by applicable intellectual property law. Nothing in these Terms transfers any ownership interest to you. You may not use our name, logo, or brand assets without prior written permission.

11. Security and Access

We implement industry-standard security measures including token-based OAuth authentication, TLS encryption in transit, AES-256-GCM encryption for OAuth tokens at rest, and role-based access controls. You are responsible for protecting your own passwords and connected accounts. No security measure is perfect; we will notify you of any breach required to be reported under applicable law.

12. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available” without any warranty of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by applicable law, PostBuzz LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service, including loss of data, profits, or goodwill, or unauthorised access to your content or connected accounts. Our total liability shall not exceed the amounts paid by you to us in the 12 months preceding the claim. Use of the Service is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless PostBuzz LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these Terms.

14. Export Compliance

You agree not to use PostBuzz in violation of any US export laws or trade sanctions. You may not use the platform from restricted countries or regions.

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, account inactivity over 24 months, or as required by court order or legal obligation. You may delete your account at any time by contacting support@postbuzz.ai. Upon termination we will delete or anonymise your data in accordance with our Privacy Policy.

16. Governing Law

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules. Any disputes shall be resolved in the courts of Spokane County, Washington, and you consent to the exclusive jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The effective date will be shown at the top. We will provide at least 14 days' notice before material changes take effect, either by email or by posting a notice in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

18. Data and Privacy

Use of PostBuzz is also governed by our Privacy Policy, which explains how we process personal data, who our subprocessors are, and what rights you have under laws such as GDPR and CCPA.
